Terms of Service

These Terms of Service are entered into by and between you and KITTEN DELIGHT S.R.O., a company registered in the Czech Republic (Company ID: ...), located at Kaprova 42/14, Staré Město, 110 00 Prague 1, Czech Republic ("Company", "we", "us", or "our").

Please read these Terms of Service ("Terms") carefully before using Artboom AI's website and services. By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Artboom AI, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Artboom AI provides AI-powered image generation and background removal services. Our Services include:

  • Text-to-image generation using AI models
  • Image-to-image transformation
  • Background removal from images
  • Public gallery for sharing creations

3. Account Registration

To use certain features of our Services, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Credits and Payments

  • Credits: Our Services operate on a credit-based system. Credits are required to generate images and use certain features.
  • Purchases: Credits can be purchased through our website. All purchases are processed securely through Stripe.
  • No Refunds: Credit purchases are generally non-refundable, except as required by law or at our discretion.
  • Expiration: Credits do not expire as long as your account remains active.
  • Accepted Currencies: We accept payments in the following currencies: USD (United States Dollar), EUR (Euro), and GBP (British Pound Sterling). Prices displayed on the website are converted from USD using current exchange rates.

5. Delivery of Credits

Credits are delivered instantly to your user account upon successful payment processing. Credits will appear in your account balance immediately after your payment is confirmed by our payment processor (Stripe). If credits do not appear within 15 minutes of a successful payment, please contact support@artboom.ai.

6. Non-Delivery of Credits

In the event that purchased credits are not delivered to your account due to a technical error or payment processing issue, you may:

  • Contact our support team at support@artboom.ai within 7 days of purchase;
  • Provide proof of payment (transaction ID or receipt);
  • We will investigate and resolve the issue within 5 business days.

If we are unable to deliver the credits, you will receive a full refund to your original payment method.

7. Refund Policy

Credits are generally non-refundable once delivered to your account. However, you may request a refund under the following circumstances:

  • Credits were not delivered after successful payment;
  • Duplicate charges occurred;
  • Service was completely unavailable for an extended period.

To request a refund: Email support@artboom.ai with your account email, transaction details, and reason for the refund request. Refund requests must be submitted within 14 days of the original purchase. Approved refunds will be processed within 5-10 business days to your original payment method. Partially used credit packs are not eligible for refunds.

8. Acceptable Use

You agree not to use our Services to:

  • Generate illegal, harmful, or offensive content
  • Create content that infringes on intellectual property rights
  • Generate deepfakes or misleading content of real people without consent
  • Produce content involving minors in inappropriate contexts
  • Attempt to circumvent our safety measures or content filters
  • Use automated systems to abuse our Services
  • Violate any applicable laws or regulations

9. Content Ownership

  • Your Content: You retain ownership of the prompts you create and the images you upload.
  • Generated Content: Images generated using our Services are owned by you, subject to our license to host and display them if you choose to make them public.
  • Public Gallery: If you share content publicly, you grant us a license to display it in our gallery.
  • Our Content: Our platform, technology, and branding remain our property.

10. Intellectual Property

You are responsible for ensuring your prompts and uploaded content do not infringe on third-party intellectual property rights. We may remove content that violates these Terms or applicable laws.

11. Service Availability

We strive to provide reliable Services but do not guarantee uninterrupted access. We may modify, suspend, or discontinue Services at any time with reasonable notice when possible.

12. Limitation of Liability

To the maximum extent permitted by law, Artboom AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.

13. Disclaimer of Warranties

Our Services are provided "as is" without warranties of any kind, express or implied. We do not guarantee that AI-generated content will meet your specific requirements or expectations.

14. Indemnification

You agree to indemnify and hold harmless Artboom AI from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

15. Termination

We may suspend or terminate your account if you violate these Terms. You may also delete your account at any time through your account settings.

16. Restricted Territories

Our services are not available to residents of, or persons located in, the following territories: Iran, North Korea, Syria, Cuba, and the Crimea, Donetsk, and Luhansk regions. We may also restrict access from Russia or other jurisdictions subject to international sanctions. We reserve the right to terminate accounts and refuse service to users who access our platform from restricted territories.

17. Chargebacks and Disputes

If you have a concern about a charge, we strongly encourage you to contact us at support@artboom.ai before initiating a chargeback or dispute with your bank or payment provider. Filing a chargeback without first contacting us may result in:

  • Immediate suspension of your account;
  • Forfeiture of any remaining credits;
  • Being permanently banned from our platform.

We commit to resolving legitimate billing disputes within 5 business days. If a chargeback is filed and later found to be fraudulent or unjustified, we reserve the right to pursue recovery of the disputed amount plus any fees incurred.

18. Changes to Terms

We may update these Terms from time to time. Continued use of our Services after changes constitutes acceptance of the updated Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Prague, Czech Republic.
